Website and Applications Terms of Use + TIX Terms and Conditions

Revised: 3 January 2026

These are the terms and conditions of use for www.tix.com.au (Site) and any mobile applications (Applications). The Site and Applications are operated by Tix (ABN 92 660 643 032) (TIX, we, us, our). Your use of the Site and Applications will be subject to these terms and conditions and, by using the Site or Applications, you agree to be bound by them. We may update these terms and conditions from time to time by changing them on the Site and Applications.

1. What TIX is and how it works

TIX is a marketing and promotional channel for live entertainment, including theatre, musicals, concerts, opera, dance, comedy, festivals, sport and family events. TIX promotes events and offers but does not usually sell or issue tickets directly. Instead, when you click a BUY NOW (or similar) button on the Site, you are transferred to the official ticketing provider for the relevant venue, promoter or theatre company.

For most events, your ticket purchase, payment processing, confirmation emails and ticket delivery are handled by the venue’s or event’s official ticketing provider, not by TIX. Your primary contract for the ticket is with that ticketing provider and is subject to their Ticketing Terms and Conditions and Conditions of Entry, as well as any applicable policies of the theatre company or venue and the Live Performance Australia (LPA) Ticketing Code of Practice.

For certain events or legacy transactions, TIX may act as an authorised agent and process ticket orders directly. Where that is the case, this will be made clear during the purchase process and the specific ticket terms described below will apply.

If tickets purchased via TIX are for an event at the Sydney Opera House, tickets and attendance are also subject to the Sydney Opera House General Terms and Conditions for Tickets and Attendance at Events, available on the Sydney Opera House website.

2. Using the Site and Applications

You may use the Site and Applications to browse events, view offers and follow links to official ticketing providers to purchase tickets. You must use the Site and Applications in a lawful, responsible manner and not in any way that may damage our name or reputation or that of our partners.

We may, at our discretion, restrict access to certain features, parts or content of the Site and Applications, or the entire Site and Applications, including to users who have registered with us. You must ensure any registration details you provide are accurate and kept up to date.

If you create an account or are provided with login details (such as a username and password), you must keep this information confidential and not share it with anyone. You are responsible for all activities that occur under your login. You must notify us immediately of any unauthorised use or other security breach of which you become aware. We may disable any login if, in our opinion, you have failed to comply with these terms and conditions.

We cannot guarantee that the Site and Applications will always be available, uninterrupted or error free. Features, content and availability may change, be suspended or withdrawn at any time without notice. We will not be liable to you for any such unavailability, modification, suspension or withdrawal.

3. Buying tickets and your contract

3.1 Purchases via official ticketing providers

In most cases, when you select tickets on TIX and click through to buy, you are taken to a third-party ticketing provider’s website, app or checkout. Your contract for those tickets is with that provider, not with TIX. All aspects of the purchase—including payment, ticket delivery, confirmation emails, seat allocation, changes, refunds and exchanges—are governed by the ticketing provider’s terms and conditions, the venue’s Conditions of Entry, and applicable law (including the Australian Consumer Law).

If you have any questions about your order (including missing tickets, incorrect dates, payment issues, exchanges or refunds), you must contact the official ticketing provider that processed your purchase. TIX does not have access to those ticketing systems and cannot view, change or reissue your booking.

3.2 Purchases processed directly by TIX (where applicable)

For certain events or legacy purchases, TIX may process ticket orders directly as an authorised agent for the relevant venue, promoter or theatre company.

Where TIX processes your order directly:

  • Tickets may be ordered by selecting the tickets you wish to purchase and following the prompts on the checkout page.

  • Before submitting your order (for example via a “Pay Now” or similar button), you may correct any input errors on the checkout page.

  • After placing an order, you will receive an email acknowledging that we have received your order and providing an order reference number. This acknowledgement is not acceptance of your order. Your order is an offer to buy tickets from us.

  • We may accept or decline your order at our discretion. A contract is formed only when we send you an order confirmation email stating that your ticket order has been placed (Order Confirmation).

  • Once we accept your order and send an Order Confirmation, we are under a legal duty to supply you with tickets that conform to that contract. Ownership and risk in tickets pass to you upon collection or delivery, provided full payment has been received.

4. Pricing, payment and charges

The price of tickets is as quoted on the Site or Applications at the time you place your order or as displayed on the official ticketing provider’s checkout. Unless stated otherwise, prices include goods and services tax (GST) as defined by the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Prices and fees may change from time to time but changes will not affect orders for which an order confirmation has already been issued.

Payment methods and any additional fees (such as booking fees, transaction fees or delivery charges) are determined either by TIX (where we process the order) or by the official ticketing provider. Your card issuer may also charge an online handling or processing fee. TIX is not responsible for any such issuer fees.

Online payment transactions are subject to validation checks by your card issuer. If your card issuer does not authorise payment, neither we nor the ticketing provider are responsible for any delay or failure to process your order.

5. Refunds, exchanges and cancellations

5.1 General policy

Subject to statutory rights (including under the Australian Consumer Law) and the LPA Ticketing Code of Practice, there is generally no right to a refund or exchange if an event proceeds as scheduled. This includes situations where:

  • You change your mind.

  • You can no longer attend (for example due to illness, travel or other personal circumstances).

  • You are refused entry under the venue’s Conditions of Entry (including for security, health or behaviour reasons).

  • Weather conditions are adverse but the event still goes ahead.

TIX does not offer refunds or exchanges as a result of personal circumstances.

5.2 Event cancellation, rescheduling or relocation

If a live event or performance is cancelled, rescheduled or significantly relocated by the theatre company, promoter or venue due to intervening circumstances:

  • TIX and/or the official ticketing provider will use reasonable endeavours to contact you in a timely manner with information about your options.

  • Any remedy (which may include a refund, exchange, or voucher) will be offered in accordance with the theatre company’s or venue’s policy, the LPA Ticketing Code of Practice, and applicable law.

  • You may need to apply for a remedy within a reasonable timeframe and provide proof of purchase.

If a refund is due, it will usually be processed back to the original payment method used for purchase. Unless required by law, liability is generally limited to the face value of the tickets plus any applicable fees or charges; associated costs such as travel or accommodation are not refundable.

5.3 Late arrival and conditions of entry

Admission to an event or performance is subject to the theatre company’s or venue’s Conditions of Entry. Venues may, among other things:

  • Refuse entry or remove you for breach of their conditions (for example, intoxication, inappropriate behaviour, security concerns or health and safety reasons).

  • Enforce latecomer policies, including holding latecomers at the door until a suitable break or, in some cases, not admitting latecomers at all.

If you are refused entry, removed from the venue or not admitted due to late arrival or failure to comply with Conditions of Entry, no refund or exchange will generally be provided.

5.4 COVID‑19 and health directions

Events may take place while government directions or public health orders are in force. You agree to comply with all relevant government directions, venue policies and COVID‑19 or health-specific conditions of entry that apply at the time of the event. If you, or anyone in your group, is unwell or required to self-isolate or self-quarantine, you agree not to attend the event. By attending, you assume all associated health risks. Any remedies in these circumstances will be determined in accordance with venue policies, the LPA Ticketing Code and applicable law.

6. Responsibility and limitation of liability

To the extent permitted by law, neither TIX nor the theatre company or venue is liable for:

  • Business or consequential losses, such as loss of profits, business, production, agreements, opportunity, anticipated savings, reputation or data.

  • Losses arising from events outside our reasonable control.

Where liability cannot be excluded, any liability of TIX arising out of or in connection with any contract for tickets is limited to the purchase price of the relevant tickets and to losses that were reasonably foreseeable at the time your order was accepted.

Nothing in these terms limits or excludes any rights or remedies you may have under the Australian Consumer Law or any other legislation that cannot lawfully be limited or excluded.

You agree to indemnify TIX, its officers, agents, employees, contractors and principals from any loss, liability, claim or demand (including reasonable legal costs) made by any third party arising out of your use of the Site or Applications in breach of these terms.

7. Intellectual property

All intellectual property rights in the content of the Site and Applications (including text, graphics, software, photographs, video, sound, trademarks and logos) are owned by TIX or its licensors. You may view, print and temporarily store individual pages for personal, non-commercial use only. You must not copy, reproduce, distribute, modify, create derivative works from or publicly display any part of the Site or Applications without our prior written consent, except as permitted by law.

Downloading, recording, distributing or sharing any ticketed video or streamed content accessed via TIX or our partners is strictly prohibited.

8. User content and reviews

The Site and Applications may allow you to submit reviews, comments or other user-generated content (User Submissions). You are solely responsible for your User Submissions and must ensure they are lawful, accurate, not misleading, and do not infringe the rights of any third party.

By submitting any User Submission, you grant TIX and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display that content in any media, and you waive any moral rights in that content to the extent permitted by law.

We may remove or edit any User Submission at our discretion. Complaints about User Submissions should be sent to info@tix.com.au with details of the content in question.

The Site and Applications may include links to third-party websites, offers and promotions. These are provided for your convenience only. TIX is not responsible for the content, availability, products or services of any third-party websites and inclusion of a link does not imply endorsement or association. Your use of third-party websites is at your own risk and subject to their terms and conditions.

10. Privacy

Use of your personal information submitted to or via the Site and Applications is governed by our Privacy and Cookies Policy, which is available on the Site. By using the Site or Applications, you consent to our collection, use and disclosure of your personal information in accordance with that policy.

11. General

You may not transfer or assign any of your rights or obligations under these terms and conditions or any related ticket contract without our prior written consent. We may transfer our rights and obligations at any time, provided this does not reduce your legal rights.

If we do not enforce any right under these terms, that does not constitute a waiver of that right. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.

These terms and conditions, together with any documents expressly referred to in them, form the entire agreement between you and us in relation to your use of the Site and Applications and any ticket contract handled by TIX. Contracts may be concluded in the English language only and there are no public filing requirements.

These terms and conditions are governed by the laws of the state of New South Wales, Australia. You agree that any dispute regarding these terms or any contract will be subject to the exclusive jurisdiction of the courts of New South Wales.
